A panel of the Federal Court ruled that the promotional tool “friend finder” Facebook is an advertising harassment, in a case that was presented in 2010 by the Federation of German Consumer Organisations (VZBV, for their acronym in English).
The Facebook app invites users to give permission to access the email addresses of friends or contacts on the agenda user, allowing, in turn, that the network does not send an invitation to Facebook users to join the service.
The court concluded that it is a deceptive marketing practice , confirming previous decisions of two lower courts in Berlin in 2012 and 2014, which found that Facebook violated the German laws on data protection and unfair trade practices.
The federal court also said that Facebook did not properly inform its members about how he was using their contact details.
In a statement, a spokeswoman for Facebook in Germany said it is waiting for receive formal decision and would study the arguments “to assess any impact on our services.” (Reporting by Harro ten Wolde, editing Spanish by Carlos Serrano)
