Microsoft Sues US Government at the request of customer data – Globovisión

Microsoft Corp sued the US government for the right to inform their customers when a federal agency is looking at your emails, the latest in a series of clashes on privacy between the technology industry and Washington.

the complaint, filed Wednesday in federal court in Washington, argues that the government is violating the US Constitution by preventing Microsoft notify thousands of customers about government requests for emails and other documents .

These actions violate the Fourth Amendment, which establishes the right of individuals and businesses to know whether the Government recorded or seized their property, argues the demand and the First Amendment on freedom of expression .

the denunciation of Microsoft focuses on data storage on remote servers, instead of doing it locally on the computers of people, something that, according to Microsoft, opened a new door for the government access to electronic data.

Thanks to the Privacy Act electronic Communications, the government is directing more and more research on sites that store data in the so-called cloud, said Microsoft.

the law, which is 30 years old, has long been criticized by technology companies and privacy advocates, who claim that it was written before the rise of the commercial Internet and is therefore out of date .

“people do not leave their rights when moving your private information from a physical storage to the cloud,” Microsoft said in the complaint, a copy of which was seen by Reuters. He added that the government “exploded the transition to cloud computing as a means to expand their power to conduct secret investigations”.

In the application, Microsoft said that in the last 18 months received 5,624 orders legal, of which 2,576 were forbidden to reveal that the government is asking its customer data through orders, subpoenas and other requests.
