Facebook will face a class action lawsuit for allegedly violating the privacy of its users to scan the contents of private messages for advertising purposes.

Judge Phyllis Hamilton in Oakland, California, last week rejected largely requests for Facebook to dismiss the complaint says the ABC.es portal.

Before the social network had argued that the case analysis messages from users was not illegal because of an exception to the Federal Law of Electronic Communications Privacy interception by service providers, which occur in the ordinary course of business.

Yet The judge said Facebook “was not offered a full explanation of how the contested practice falls in the ordinary course of business”.

The lawsuit was filed in 2013 and alleged that Facebook scans the content private messages sent between users that contain links to websites, to tell the interaction as “Me Gusta” page.

They note that those “Me Gusta” is then turned into advertising to users.

The ruling by Judge notes that Facebook ceased these practices in October 2012, however, still scanning messages for viruses and spam.

The complaint was made by the user Matthew Campbell and seeks class-action status, ie, on behalf of all “users in the United States” that send or receive private messages which include website addresses.
